Terms of Service Agreement

In addition to the terms below, the Customer agrees to supervise the use of game trucks and further agrees that if any item is damaged that he/she will reimburse GOOD GAMING COMPANY LLC for the full price to fix the damage and/or the full replacement value of the rented item. Before signing this contract, Customer agrees that he/she has read the entire contract, has agreed to all terms and conditions herein, and has had all questions answered to full satisfaction and understanding.

COVID RESTRICTIONS: All guests must wear masks at all times while inside the game truck and make efforts to maintain social distance. Guests that feel sick or have recently come into contact with someone exhibiting cold/flu-like symptoms must NOT enter the game truck. Maximum of 10 guests allowed inside the game truck at any one time. Wash hands and use hand sanitizer frequently during events.

Delivery/Operation/Payments: Customer agrees to provide adequate space for driver to park truck and trailer safely in an area that is free from any potential damage to equipment. If adequate and safe parking is not ready when the driver arrives, there will be no adjustment to event time; no refunds or rain checks will be given for time that driver has to wait for parking to be made available.

General Rules for Safe Operation: Trailer must be parked on a smooth, clean and level surface. The trailer may NOT be parked on mud, sand or rough surfaces such as rocks, brick, glass, or any jagged objects. Equipment MUST BE properly parked and level prior to use. Once the Game Trailer is parked, it MUST NOT be moved during the event. Truck must be connected to the trailer at all times during the event. Additional Safety Rules: Weapons of Any Kind in or Near Game Trailer are Strictly PROHIBITED. Always have an adult present, who has reviewed and understands both this contract and the rules for the Game Trailer. Never allow the users to be unsupervised in or around the unit. Never allow more users than the maximum number of users per age group as directed by Game Attendant. Food, drinks and confetti-type material (glitter, silly string, etc.) is not permitted in game trailer. Do not allow horseplay on, in, or around the equipment. Always follow the directions of the Game Attendant.

Additional Terms of Service: GOOD GAMING COMPANY LLC is not responsible for bad weather, disruption of electrical service and/or unfavorable conditions that may arise and no charges or fees will be reimbursed as a result. Absolutely no silly string or similar items, such as, but not limited to, food, drinks, confetti, foam or trash, in or around the game truck at any time. Customers will be responsible for the full replacement value of the equipment and/or assessed up to a $250.00 cleaning fee. Customer agrees not to operate the equipment in a manner contrary to this contract and the rules of use. If Customer uses the equipment in a manner contrary to the contract and rules of use and direction of the Game Attendant and the unit is damaged, Customer agrees to pay the cost of repair or full replacement value of any damaged equipment. Customer further agrees to be liable for any loss of said equipment by reason of fire, theft, or any other cause. Customers may also be responsible for any loss suffered as a result of the company not being able to service other parties.

Hold Harmless Provisions: Customer agrees to indemnify and hold GOOD GAMING COMPANY LLC harmless from any and all claim, actions, suits, proceedings, costs, expenses, fees, damages and liabilities, including, but not limited to, reasonable attorney’s fees and costs, arising by reason of injury, damage, or death to persons or property, in connection with or resulting from the use of the equipment. This includes, but is not limited to, the manufacture, selection, delivery, possession, use, operation, or return of the equipment. Customer hereby releases and holds harmless [setting:company_name] from injuries or damages incurred as a result of the use of the equipment. GOOD GAMING COMPANY LLC cannot, under any circumstances, be held liable for injuries as a result of inappropriate use, God, nature, or other conditions beyond its control or knowledge. Customer also agrees to indemnify and hold harmless GOOD GAMING COMPANY LLC from any loss, damage, theft or destruction of the equipment during the term of the event and any extensions thereof.

Payment and/or Credit Card Charge Authorization: Customer agrees that equipment has been delivered in satisfactory condition and company has provided service as agreed for the price as agreed and agrees to pay for service in full and will in no way dispute any charges related to this service. Customers are satisfied with equipment and service and agree that any charges made by credit card will be paid in full and will in no way dispute any charges because they are completely happy with the equipment and service provided.


Breach/Indemnity/Arbitration: In the event that Customer breaches any of the terms of this contract, that Customer will pay for all consequential damages and further indemnify GOOD GAMING COMPANY LLC for all costs incurred by goodgamingcompany incurred in enforcing the terms of the contract or in defending any claim or lawsuit arising out of the operation of said equipment, including the amount of any judgment, attorney’s fees and costs. If GOOD GAMING COMPANY LLC determines, within its own discretion, that Customer has failed, in any way, to observe or comply with the conditions of this lease, GOOD GAMING COMPANY LLC may exercise any of the following remedies: termination of this agreement; re enter property and retake the equipment; declare any outstanding fees and charges immediately due and payable and initiate whatever legal proceedings necessary to recover said equipment or monies; and/or pursue any additional remedies available it by law. If a conflict arises, GOOD GAMING COMPANY LLC and Customer will abide by the GOOD GAMING COMPANY LLC state laws and forgo filing a lawsuit to solve the dispute.

BY SIGNING MY NAME ON THIS CONTRACT I, BEING THE CUSTOMER, CONTACT PERSON, CUSTOMER REPRESENTATIVE, OR OTHER INDIVIDUAL ASSUMING THE ROLE OF CUSTOMER, ACKNOWLEDGE THAT I HAVE COMPLETELY READ AND UNDERSTAND THIS CONTRACT AND ANY AND ALL ACCOMPANIED ADDENDUM(S). I HAVE BEEN FULLY INFORMED BY GOOD GAMING COMPANY LLC PERSONNEL AS TO THE SAFE OPERATION FOR THE AFOREMENTIONED EQUIPMENT AND HAVE HAD ALL OF MY QUESTIONS ANSWERED TO MY SATISFACTION. I UNDERSTAND THAT I AM SOLELY RESPONSIBLE FOR ADHERING TO THE TERMS SET FORTH BY THIS CONTRACT AGREEMENT AND ANY AND ALL ACCOMPANIED ADDENDUM(S).
